These Terms govern your use of Bookku — the booking platform at bookku.co and all tenant subdomains (yourshop.bookku.co). By signing up or using Bookku you agree to these Terms. 1. Who we are1. เราคือใคร
Bookku is operated by Lertrak Chakatdechawong, a sole proprietor based in Bangkok, Thailand. Contact: lertrak@bookku.co. References to "we", "us", "Bookku" refer to this entity.
2. Who can use Bookku2. ใครใช้ Bookku ได้
- You must be at least 20 years old (age of majority in Thailand) or have your parent/guardian agree on your behalf.
- You must operate a legitimate business (clinic, studio, court, hotel, salon, etc.). Bookku is not a consumer product.
- You must comply with Thai law and any applicable industry licensing (medical, hospitality, etc.).
3. Free trial3. การทดลองใช้ฟรี
Every new account gets a 14-day free trial with full Solo-tier features. No credit card or PromptPay slip is required to start. At the end of day 14, you'll be asked to choose a paid plan or your account will pause (read-only) for 30 days before scheduled deletion. No surprise billing.
4. Plans and pricing4. แพ็คเกจและราคา
- Plans and prices are listed at bookku.co/pricing.html and may change with 30 days' notice for active subscribers.
- Monthly billing — paid at the start of each calendar month via PromptPay.
- Annual billing — paid upfront, saves 2 months. Default option.
- No setup fees, no per-booking commission, no per-staff seat charges. The price on the card is the price in full.
- VAT — prices exclude 7% VAT where applicable; tax invoices are available on request.
5. Cancellation, refunds, and downgrades5. การยกเลิก การคืนเงิน และดาวน์เกรด
- Cancel any time — no contracts, no minimum term. Self-serve cancellation from your admin panel.
- Monthly plans — cancellation takes effect at the end of the current billing cycle; no proration.
- Annual plans — refund of the unused months is available for the first 30 days after payment. After day 30, the annual term runs to its end but auto-renew is disabled.
- Upgrades — prorated and effective immediately.
- Downgrades — take effect at the end of the current billing cycle.
- Data after cancellation — exported for 30 days; you can re-activate within that window. After 30 days, personal data is anonymised per our Privacy Policy.
6. Acceptable use6. การใช้งานที่ยอมรับได้
You may not:
- Use Bookku for illegal activity (Thai law applies).
- Send unsolicited bulk messages ("spam") via Bookku's email or LINE channels.
- Sell services that violate Thai consumer-protection law, FDA regulations, or PDPA.
- Attempt to bypass rate limits, abuse subdomains, or circumvent tenant isolation.
- Reverse-engineer, white-label, or resell Bookku without a written partnership agreement.
Material breaches of acceptable use may result in account suspension without refund. We'll send written notice and a 7-day cure period where the breach is correctable.
7. Your data, your responsibility7. ข้อมูลของคุณ ความรับผิดชอบของคุณ
You retain ownership of all data you put into Bookku — your services, your customer list, your bookings. We process this data only on your instruction (we are a Data Processor; you are the Controller). You are responsible for the legality of what you collect from your end-customers, including obtaining their PDPA consent, publishing your own privacy policy (we provide a template at brand_assets/privacy_template.md), and honouring their PDPA rights within 30 days.
8. Bookku's responsibilities8. ความรับผิดชอบของ Bookku
- We aim for 99% monthly uptime, measured per calendar month. We do not currently offer a financial SLA credit, but if monthly uptime falls below 95%, contact us within 30 days for a discretionary partial-month credit.
- We will notify you of scheduled maintenance in advance via email.
- We will tell you when we add new sub-processors before they go live (currently listed in our Privacy Policy).
- We will preserve your data integrity with daily backups, encryption in transit and at rest.
9. Limitation of liability9. ข้อจำกัดความรับผิดชอบ
To the maximum extent permitted by Thai law, Bookku's total liability for any claim arising from your use of the service is capped at the total fees you paid Bookku in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost bookings, reputational harm). This cap does not apply to: (i) liability arising from gross negligence or wilful misconduct, (ii) violations of PDPA where Bookku is the Controller, or (iii) where the cap would otherwise be invalid under Thai consumer-protection law.
10. Force majeure10. เหตุสุดวิสัย
Neither party is liable for delays or failures caused by events beyond reasonable control — including natural disasters, government action, hosting-provider outages outside our SLA, or internet-wide DNS/transit failures.
11. Changes to these Terms11. การเปลี่ยนแปลงเงื่อนไข
We may update these Terms when our practices or laws change. Material changes affecting current subscribers will be announced by email at least 30 days before they take effect. Continued use of Bookku after the change constitutes acceptance. If you don't accept a material change, you may cancel within those 30 days for a prorated refund of any pre-paid annual fee.
12. Governing law and disputes12. กฎหมายที่ใช้และข้อพิพาท
These Terms are governed by the laws of Thailand. Any dispute that cannot be resolved by good-faith discussion will be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand. The Thai-language interpretation of these Terms prevails in any conflict with translations.
